Bulan’s “Blood” Sand
Weeks ago, incessant rains claim at least 20 lives and left over a thousand families homeless in Bulan’s adjacent towns of Magallanes and Juban as well as barangay San Roque, Bulusan. A great mass of earth denuded by loggers (I’m not sure if they are “illegal” loggers since both the laws of rebel NPA and infidel PNP tolerate rape of our forests) collapsed and buried the Barangays of Incarisan in Magallanes, and certain barangays of Juban.
In Bulan, barangays San Vicente and Managa-naga, flood waters rose to a record high of at least 4 feet deep. The “elite” Immaculate Conception subdivision (built along historic Banuang Daan River) was practically underwater when the continuous rains of February rose to a little less than 5 feet deep eroding the river bank together with the several houses built alongside.
The same was true with the over-rated Villa Las Palmas subdivision which looked like a lagoon after heavy rains poured over the province. The Villa Las Palmas experience, however, was not a surprise to many. The area is a natural catch-basin for Sta. Remedios rainwaters and the nearby Calomagon and San Juan highlands. Many even wondered why this place was converted into subdivision when even on ordinary days the area is easily flooded due to its low location.
Heaven forbid! But Bulan may just be another disaster-stricken town at the rate our coastline is being shaved-off of our precious margaha sand.
Incidentally, Fr. Josefino Bayto Chavenia or Fr. Chubby (pronounced “Choo-by”)’s first death anniversary was remembered last March 9, 2008. That day fell on a Sunday the Gospel of which is about death and resurrection – a coincidence that seemed to tell us what Fr. Chubby died for: standing up for what is right even if it meant losing his life.
Fr. Chubby knew he has a failing heart. But this he kept from those he loves. Having a heart ailment for years already, he did not talk about it. It did not even stop him from joining, nay leading, his parishioners to a “heart-straining” rally to protest the reopening of the Lafayette Mining operations in Rapu-Rapu, Albay.
That year, March 9, 2007, Fr. Chubby braved the long march around Sorsogon’s capital. He marched with the farmers, the poor, the lay people and Sorsogon’s professionals. Sadly though, along with Fr. Chubby’s death so was Sorsogon’s mass actions against what ails our country today.
Corruption in grand scale abounds. Government leaders with no shame at all parade their loot as though they’ve won it from a lottery. Calls for reform or resignation are continuously ignored.
Under the scorching heat of last year’s summer sun Father Chubby offered his life – to save our environment from the pillage of greed-driven individuals and their equally greedy partners in government.
He heeded his bishop’s call to stage a mass action in Sorsogon to protest the ongoing mining by foreign nationals in the island of Rapu-Rapu in Albay. Little did Fr. Chubby know, however, that a much the same pillage of our environment is happening in his own hometown of Bulan.
Yes, this quiet little town of Bulan is being shipped to China by its very own Papay and Mamay!
And it happened just when everybody thinks Guiming De Castro bought the town already, because of his “rumalayas na kamo sa Bulan caper”.
Well, we were all wrong. Guiming and Rosa de Castro are actually selling Bulan, tons by tons – at the expense of our very own safety.
In late 2006, ALEXANDRA MINING VENTURES purportedly secured an environmental compliance certificate (ECC) from the Department of Environment and Natural Resources to engage in quarrying of magnetite sand along the northern coastal barangays of Bulan, one of which is barangay Namo.
In one of its operations last year, Alexandra Mining shipped a total of 2,907 metric tons to Jingtang Gang, China on board M.V. “Pine Pia” and the cargo is consigned to one Wong Tai General Merchandize Ltd. of Wan Hai, Hong Kong.
Sorsogonnews checked the credentials of Alexandra Mining and found it to be holding office at No. 39 Carmel Subdivision, Project 6, Quezon City and, just like Geming’s supposed contractor of the bus terminal, Alexandra Mining is, conveniently, a “single proprietorship” owned by one CESAR ESTAYAN DETERA.
Magnetite sand is commonly known in Bulan as margaha. The beaches of Pon-od, Inararan up to Danao are covered by this magnetic sand, believed to have been carried by the waves to the shorelines from the sea. Those of us who studied grade school in Bulan must have participated in a science experiment where we discovered margaha’s magnetic qualities. Remember the speckles of margaha “dancing” on top of a sheet of paper as magnet is moved from corner to corner of the paper?
Articles in the web place the selling price of margaha in Nevada, U.S.A., ranges from $40 to $52 per kilo or Php.1,600 to Php.2,080 per kilo. If you care to compute how much 2,907 metric tons of margaha cost, roughly, it would be P6M. Considering that Alexandra Mining ships margaha to China on the average of 3,000 metric tons per quarter, Bulan would have had earned millions of pesos, too, from fees and taxes levied and assessed from Alexandra Mining.
But there’s the rub!
Barangay Namo does not receive a single centavo from Alexandra’s margaha quarrying. The quarry operators even exploit barangay folks and children by paying them a measly pay of 80 centavos for every kilo of black sand they haul from the shorelines to Alexadra’s dump site, some 300 meters away.
Sorsogonnews also managed to photograph the quarry site and saw that most of Bulan’s heavy equipment service Alexandra Mining’s operation from day one to this day. Had the rental for these equipment, like the backhoe in the picture, been properly charged and collected, Bulan’s coffers would have been enriched by at least P720,000 per quarter.

A check made with Bulan’s 2008 Annual Budget, however, reveal no such income from an obviously profitable undertaking. In 2006 (the year Alexandra Mining started its operation in Bulan), the municipality of Bulan, under the auspices of Rosa De Castro, reported a measly sum of P479.00 pesos as taxes collected from “sand, gravel and other quarry products”.
In Rosa’s approved annual budget this year (2008) income estimate for quarrying is unimaginably placed at P20,000 only – a stark contrast to the annual 24 million pesos Alexandra Mining is profiting from margaha! Pira na milyon an nawawara sa taxes and fees na dapat bayadan san paghakot san margaha pakadto sa China!
Since Bulan’s heavy equipment are being used, it is also surprising that Bulan has no income estimates for its rentals. Or is it just a scheme to keep us in the dark as to the real income of our municipal government so they can go on with their unhampered misuse of the people’s money?
Curiously, Bishop Arturo Bastes of the Diocese of Sorsogon and most of the Sorsogon clergymen who decried the La Fayette Mining in Rapu-Rapu, Albay are all quiet as to this latest environmental fiasco. Bishop Bastes, who practically pushed Fr. Chubby to death with his ephemeral environmental concerns, has suddenly fell deaf and dumb to what’s happening in his Diocese. Or, to say the least, to what Fr. Josefino Chavenia has died for!
Their eerie silence is truly disturbing, reminiscent of a decadent society lending credence to allegations of bribery reaching the portals of the temple.
With neither drums nor trumpets, Fr. Chubby did his “good sheperd” job. He offered his life if only to save his flock from environmental disaster. I just hope he did not die in vain or we will all be heading to eternal damnation. The least we could do now is to “expose society’s wounds to the light” so the culprits may be brought to justice.
Or margaha could just be Bulan’s “blood” sand.

Thank you Kabatas for featuring this BLACK SAND SCAM by the De Castros. I have mentioned about this anomaly in my 3/24/2008 comment on “The Truth About the P80 Million Bulan Bus Terminal Mandamus” webpost. The people of Bulan must fully know the details of this corruption considering the fact that one of the priorities under the HELEN program of the beautiful mayor is ENVIRONMENT. And yet they have the guts to broadcast their superficial concern on the protection of environment via the PISTA SA KABUBUDLAN celebration but the very same dumpsite in Calomagon also served as the segregation facility of the mining firm that bought the black sand from Guiming. How ironic. Kawawa na naman an mga “padaba nira na taga-bulan.”

anyway, relative to this Bulan “blood” Sand article, and perhaps by analogy too, I did recall, during the 1991 eruption of Mt. Pinatubo, millions of tons of Lahar — a sandy volcanic debris — have covered wide areas in Pampanga, notably rivers, rice fields, farms, roads, etc.
“Quarry operators dig out Lahar and sell it to dealers of construction materials as an aggregate for concrete. It is like sand, but lighter. The operators make good money because this free resource is just lying there waiting to be shoveled, loaded, carted away and sold for a good price”. To keep the lucrative business going, operators share their fortune with public officials i.e. governor, mayors, et al,” columnist Federico Pascual said in one of his write-ups a year ago.
This Toll (actually “tong”) collection rakes in dirty millions for some municipal and provincial officials. Quarrying and other fees that should go to government end up in private pockets of public officials, et al…
…..thus, for allegedly pocketing millions of pesos thru tongs (with unsupported receipts ) and kickbacks then Pampanga Governor Manuel “Lito” Lapid and cohorts were allegedly charged before the Office of the Ombudsman for “Dishonesty, Grave Misconduct and Conduct Prejudicial to the Best Interest of the Service” for allegedly “having conspired between and among themselves in demanding and collecting from various quarrying operators in Pampanga a control fee, control slip, or monitoring fee of Px-x-x-x per truckload of sand, gravel, or other quarry material, without a duly enacted provincial ordinance authorizing the collection thereof and without issuing receipts for its collection. They were also accused of giving unwarranted benefits to private individuals, who are not quarry operators by allowing them to collect the said amount which was over and above the Px-x-x-x prescribed under the present provincial ordinance and in allowing them to sell and deliver to various quarry operators booklets of official receipts which were pre-stamped with “SAND FEE Px-x-x-x.
As a result, then, pampanga Governor Manuel “Lito” Lapid was formally indicted before Sandigan Bayan and trial ensued thereafter. But, when, Lito was elected as Senator, he was succeeded by his son, Governor Mark, who had just followed the footsteps of his father, (as the saying goes, like father like son, or birds of the same feather, flock together) and was also charged and indicted before the said court for allegedly committing the same crime and felony/s that of his father. Unfortunately, when Mark sought a re-election, he was defeated by father Ed Panlilio, a catholic priest…. both, Mark Lapid “a.k.a. Lahar King” and Baby Pineda, “a.k.a. Jueteng Queen” of Pampanga were defeated, by father Emong Ed, as the alternative choice of the Kapampangans. At present, I have no update yet as to the status of their case in court, (i.e., Sandigan Bayan, Court of Appeals, or the Supreme Court)
…… going back to the Bulan blood sand article, I would surmise that the prospect of exporting ‘very valuable’ resources like margaha sand (magnetic sand) would bring about untold economic gains to the town of Bulan. (kun deri pagpara-ralabutan an pondo sine, kaso sa iba siguro nakakadto an pondo)
….., a closer look on the annual cost of the sands/aggregates would reveal the enormous volume of sand that would be exported or shifted out to China may translate into million of pesos income of the town of Bulan for sand each year. But, suppose the supply of sand and gravel in the barangays, Namo, Danao, Pun-od and Inararan shorelines, are totally depleted, will the situation not put pressure on private contractors/quarry operators to get their supply of sands/aggregates from other sources [e.g., hills and mountains]?
When the object of quarry operations shift to the hills and mountains, then we can expect tremendous environmental repercussions like removal of forest cover, soil erosion and flooding not only in the barangays of Namo, Danao, Pun-od and Inararan but also in nearby localities. These potential eventualities may bring about huge losses in terms of life, property and livelihood…(basi ugang mapareho kita suon sa real-infanta in quezon province, or the just recently catastrophic landslide in magallanes)
Will the expected economic gains far outweigh the potential damage to the environment that the supply of margaha sands to China would bring?”
Perhaps, our local official must take into consideration the safety of the people in the said localities first, before hallucinating for fat commissions, if any… batu-bato sa langit…
… by allowing the quarry operator/contractor to dredge or dig out sand from the shorelines of the aforementioned barangays, our government official/s will be committing betrayal and mass slaughter of the people of Namo, Pun-od, Danao and Inararan and nearby barangays KAPAG NANGISOG AN KALIKASAN sa paagi san pagbaha, bagyo na ugis, linog, tiris san mga bulod, uran na deri naghuhuraw, kil-at na may ngipon kaupod an nan nagtatagungtong na dalugdog.
The estimated annual income annually or more than thousands or millions of tons of gravel and sand, enough to sink these barangays and nearby localities in the years and years to come, if this project will not be stopped, right now, right then and right here…… This is unimaginable and catastrophic!
but, before the town of Bulan would sink, thru quarrying or dredging of shorelines, hala tama si Guiming na “MAGRALAYAS NA KITA SA BULAN”..
…..please stop raping our natural resources……

Well, what’s the next step??? File a case with the Ombudsmann? It’s now time to act so I appeal to all sane TagaBulans to take the next step now to stop this prohibited child labor, environmental crime and systematic looting of Bulan by these people. Organize yourselves and go to the streets and make known what you think and what you feel! Democracy is all about that, it’s your government, it’s rule of the people! So make it known to the entire Bulan that kleptocracy is not tolerated in our town! Move now before Bulan is damaged forever! We have written enough, we know enough, now it’s the time for action! In unity- as we all know- there is strength!
No, Fr. Chubby did not die in vain! For now we have a true tagaBulan who will guide and inspire us in our present fight against the destruction of Bulan. In him we found a true symbol for what Bulan really stands for- moral integrity, loyalty, dedication to duty and bravery. It is just our bad luck that we ended up with people in the government who are there to pirate Bulan. For now , my kabungtos, all roads lead to Bulan, not to Rome. We have seen once again that Rome is not there for our cause, it’s not there for our Fr. Chubby, it’s not there for you and me. It’s there for those who can pay.
Protect the integrity of Bulan- that is our responsibilty. Leave your comfort zones now and act as one, one people who fights for a noble cause- PROTECTION of democratic ideals, of children and environment.
Bulan deserves a bright future!

To add a bit insight, re employment of children, Nonong G. has categorically stated that “quarry operators even exploit barangay folks and children by paying them a measly pay of 80 centavos for every kilo of black sand they haul from the shorelines to Alexadra’s dump site, some 300 meters away.”
Suppose, the aforecited allegation is true, then, I would say that the quarry operator or contractor is probably guilty for violation of RA# 9231, popularly known as the “Anti Child Labor Law”, which took effect sometime on December 19, 2003.
And, on the other hand,………… in appealing to all sane tagaBulans, mr. Jun A, in his comment, is even more emphatic and inistent by urging all sane tagaBulans to go out of the street and organize themselves to protest and condemn the exploitation of these children, saying that “It’s now time to act so I appeal to all sane TagaBulans to take the next step now to stop this prohibited child labor”.
Indeed, the law on anti-child labor seeks to eliminate the worst forms of child labor such as those involving slavery: such as the sale and trafficking of children, debt bondage, serfdom, including recruitment of children for use in armed conflict; prostitution and pornography; use pf children for illegal activities, including drug trafficking; and any work that is hazardous and harmful to the health, safety and morals of children.
Among the salient features of the law (RA#9231) is the stipulation that children below 15 years of age, if working in non-hazardous conditions, may work for not more that 20 hours a week, at most 4 hours a day. The law limits children 15 – 17 years old to work not more than 8 hours a day or 40 hours a week. Night work from 8pm to 6am is prohibited. (house & senate version)
The law also states that children should receive and own their wages. The child’s earnings shall be set aside primarily for his/her support, education or skill acquisition and not more than 20% of the child’s income may be allotted for the collective needs of the family.
Employers (i.e. quarry operator) on the other hand are instructed to provide the working child access to al least primary and secondary education. In line with this provision, the Department of Education shall design and make available to working children alternative and non-formal education courses.
The government (i.e. LGU of Bulan, DSWD, etc.) shall also provide and make accessible to working children free and immediate legal, medical and psychological services. Victims of child labor shall be exempted from paying filing fees for recovering civil damages.
The new law also provides for stiffer penalties against acts of child labor, particularly in its worst forms. It increased the penalties against abusers to a maximum of P5 million and 20 years of imprisonment. The Department of Labor and Employments is given the authority to close down business establishments found violating anti child labor provisions of the new law. (senate version)
Some labor analysts say that “RA 9231 is, in effect, sending a strong signal to employers and recruiters to stop abusing and exploiting children because stiffer penalties encourage parents and the victims to seriously pursue their complaints in court”….
The passage of the law is a great victory for the Filipino working child. However, the real test lies in its implementation…….
In fact, despite the existence of the Implementaing Rules and Regulations (IRR)or better still the implementing guidelines (re, anti-child labor law) passed and approved by the implementing agency/bureau, still the matter of actual IMPLEMENTATION of the Law in the country has always been the problem, as nobody would want to take a cudgel to spearhead the actual enforcement or implementation of the law or rule….
in the case of these exploited children, WHO WILL TAKE CHARGE OR INITIATE THE FILING OF A CASE IN COURT AGAINST THE ABUSIVE EMPLOYER? it’s so sad to learn that flood waters “rose to a record high of at least 4 feet deep.” as i recall it right, our place’s former name was canipaan (zone 5) because there were so many nipa trees there before. nagtutubo lang baga ang mga nipa sa harani sa salog na sa pagkaka aram ko kay sige ko man hamok an boradol sadto sa solod san sli/krams may-on doon sin sapa o saday na salog sa likod na sakop na san managa-naga.
it was mid 1990’s when the government backfilled it for housing purposes without any consideration that the place was a river basin. na kun matatambunan salog na wara hihimuon na diversion canal, talagang babahaon ang poblacion san bulan! bata mao ini an hinimo ko sadto na case study sa water resource planning subject ko san nag eeskwela pa ako inhenyeria. the officials didn’t anticipate it then, though. or they just don’t care. an importante may proyekto an national government para may mawisik na grasya, no matter kun sin-o ang maaapektuhan.
during my college days, napa entra ako sini na bulan ecological alliance movement (beam) na pinamumunuan sadto ni fr. angel dy. experts then said that if the illegal logging will continue in the mountains of bulan and magallanes, time will come na mauubos an tubi nato. when i went on vacation in bulan in 2005, ay badaw na pagkaluya-luya san tubi. sanay po pan-o ako na dinakuan ko na kun nakukusog an abri san gripo o shower, malaniton sa kusog san pressure. wara na po ini.
an now the margaha issue. i’m glad na na puna po kaagad ito… i know margaha batog san bata pa ako and i know it now for we use it in our company where i’m currently working. we import it for bloody high cost! tama po an presyo mo kabatas. i’m just praying na mabiyayaan man in terms of quarry and heavy equipment taxes ang mga taga bulan lalo na ang barangay na inkukuwaan sini na margaha base sa nakabutang sa batas.

another milestone of informations about our beloved hometown-thnk you N. G!
and honestly, im scared of your life NG for this. your bravery in bringing out courageously the wounds of Bulan, even the churchs` laymen are starting to be my inspiration esp. the heroic death of Fr. Chavenia. An inspiration to do what i can to CORRECT, REDUCE OR END this strings of hell-oic ABUSES san mga nasa pwesto over the local people of Bulan.
This town belongs also to me. I was born there, grow up and love my hometown no matter what. Thus, i claim my privilege to
do what i think is right for my beloved hometown. Its about time to save BULAN. We have no millions to match with our turned “bigtime” politicos, but we are equipped with knowledge, unity and basic reasons to defend and save Bulan.

But before you can get away with your next targeted millions, please do not forget that there are “native TAGABULANS” somewhere out there watchin you, eyes wide open, efficient ones, who are deliberately very much aware of your KALOKOHANS and God forbid, Justice will be served.

….. very frustrating because Fr. Josefino Chavenia died of a heart attack while attending a rally against “extra-judicial killings” in Sorsogon province, (likewise in Bulan in particular), whether extra-judicial killings is perpetrated by military (death squad) or the insurgents CPP/NPA (liquidation squad).
He is actually the champion of the people – in their quest for justice against the still unsolved, and continued extra-judicial killings, and disappearances, of the militants or otherwise in our midst.
It was very unfortunate that his (heroic) death occurred during the “rally for life.”, actually a prayer rally to protest the continued killings of militants in the province. Indeed, the continued killings have sown fear among the people of Sorsogon.
The Extra-judicial killings, or “Salvaging” (a police lingo)also known as “summary execution” – continued to sow fear and terror among the people because of the failure on the part of the government to properly address, or strengthen the pillars of criminal justice system in the country. (in relation thereto, I posted an Article in the Bulan Observer blog of mr. jun A., re Criminal Justice System in the country, a dysfunctional system, or effective crime deterrent?)
For me, once the criminal justice in the country, in Sorsogon or Bulan in particular, is rotten, “sigurado wara kita sin maasahan na hustisya.”… sige lang an paratayan, wara sin nakukulong o nasesentensiyahan….wara sin matestigo,,, nan posible na pagnag expose ka san anomalia sa gobierno, pag-uli mo sa balay, badilon ka tumba…. tigbak….. the killer is nowehere to be found…..

ambot nalang sa ato doon! mapagalon man pag isipon na bagan wara na maiimod na pag asa. makulogon man sa boot na kaipohan pa namo na biyaan an bulan na para makisapalaran sa iba na lugar para maka haw as man lang san kapobre. kunta sa bulan namo in aalay an kusog para sa pag unlad pero hain kami nyan yaadi sa iba na lugar nagsisirbi. pait gyud kaayo ang kinabuhi lisud magpili. but still im hoping and praying that god will pour grace and mercy to my lupang tinubuan “BULAN”.
